Welcome to Sundreas. These Terms of Service govern your use of our website and services, including but not limited to online games, cryptocurrency transactions, and USD accounts. By accessing or using our services, you agree to be bound by these terms. If you do not agree to these terms, please do not use our services.

2. Eligibility

By using our services, you confirm that you are at least 18 years of age or the legal gambling age in your jurisdiction, whichever is higher. You also acknowledge that it is your responsibility to ensure that the use of our services is legal in your jurisdiction. We reserve the right to terminate or suspend accounts if we determine that you do not meet these eligibility requirements.

3. User Accounts

To use certain features of our website, such as in-game activities, betting, or utilizing USD and APY accounts, you may be required to create an account. We do not require users to provide any personally identifiable information (PII) for account creation or to access services. User accounts are pseudonymous, and we do not collect information that can be used to identify users.

4. In-Game Features and Cryptocurrency Transactions

You agree to use cryptocurrencies that are supported by the platform. Any attempt to use unsupported or invalid cryptocurrencies may result in lost funds, and we will not be liable for these losses.

5. USD Account and APY Services

**Funding USD Accounts**: Users can fund their USD account by depositing supported cryptocurrencies and using our internal swap service to convert crypto into USD. There is no option to directly deposit fiat currency (USD) into the account.

**APY Account**: To earn interest, users must transfer funds from their USD account into a dedicated APY account. The Annual Percentage Yield (APY) for the APY account is determined by us and is subject to change at any time without prior notice. Interest is calculated daily and credited monthly to the APY account balance.

By using these services, you agree to the following:

  • Funds must first be swapped from cryptocurrency into USD via our internal swap service before they can be transferred to the APY account.
  • Your USD balance in the APY account will be subject to the APY rate in effect at the time of transfer.
  • Funds must be transferred from the USD account to the APY account to earn interest.
  • We reserve the right to modify or discontinue the APY feature at any time without prior notice.
  • There may be withdrawal limits or fees associated with transferring funds from the APY account back to the USD account or withdrawing from the USD account.

6. Prohibited Activities

You agree not to engage in any activities that violate laws, infringe on the rights of others, or disrupt the proper functioning of our website. Prohibited activities include, but are not limited to:

  • Using automated scripts, bots, or VPN/proxies to manipulate the outcome of games.
  • Engaging in fraudulent or deceptive activities.
  • Posting offensive, harmful, or illegal content in any communication channels related to the website.
  • Creating multiple accounts to cheat or manipulate the system.

7. Third-Party Links & Ads

Our site may contain links to third-party websites and display advertisements. These third-party links and ads are not under our control, and we are not responsible for the content or policies of these third-party services. 9. Limitation of Liability

To the fullest extent permitted by law, Sundreas shall not be liable for any direct, indirect, incidental, special, or consequential damages resulting from the use or inability to use our services. This includes, but is not limited to, loss of profits, loss of data, and interruptions in service. Our maximum liability to any user shall not exceed $50.

10. Changes to These Terms

We reserve the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting. Continued use of our services indicates your acceptance of the modified terms.

11. Governing Law and Dispute Resolution

These Terms of Service are governed by and construed in accordance with general principles of law applicable to online services operating globally, without regard to conflict of law principles.

Binding Arbitration: By using Sundreas, you agree that any and all disputes, claims, or controversies arising out of or related to these Terms of Service, or the breach, termination, enforcement, interpretation, or validity thereof, or your use of the website, shall be settled by binding arbitration. This includes any claims against officers, directors, employees, or affiliates of Sundreas.

Waiver of Court and Jury Trials: You acknowledge and agree that, by agreeing to these Terms, you and Sundreas are each waiving the right to a trial by jury or to participate in a class action. All disputes will be resolved on an individual basis, and not in a consolidated or class action.

Arbitration Procedure: Arbitration will be conducted confidentially by a single arbitrator in accordance with the rules of an internationally recognized arbitration organization mutually agreed upon by the parties. The arbitrator's decision will be final and binding, and judgment on the award rendered by the arbitrator may be entered in any court of competent jurisdiction.

Exceptions: Either party may bring a claim in small claims court for disputes within the scope of that court’s jurisdiction. Additionally, Sundreas may seek injunctive relief in court to prevent unauthorized use or misuse of its intellectual property.

Governing Law Flexibility: Since Sundreas is an international service, you agree that the arbitration will occur in a neutral location agreed upon by both parties, or conducted online, with the applicable law being general principles of fairness and equity commonly accepted in international arbitration.

12. Account Termination and Banning

Sundreas reserves the right to suspend, terminate, or ban accounts if we determine that you have violated these terms or engaged in activities that jeopardize the security, integrity, or functionality of our platform. Banning may occur in cases of fraudulent behavior, abuse, prohibited activities, or any actions deemed harmful to Sundreas or its users.

If your account is banned, you will be notified by email, including the reason for the ban. Banned accounts are restricted from accessing the platform and may forfeit any balances held on the platform at the time of banning, pending review.

If you believe your account was banned in error, please contact our support team at [email protected]for assistance. Appeals will be reviewed, but Sundreas reserves the right to make the final decision regarding account status.

You may also request to close your account at any time, subject to the processing of any pending withdrawals.

13. Privacy and Data Collection

Sundreas respects your privacy and does not require personal identifiable information (PII) to create an account. However, we may collect non-personal data, such as IP addresses, browser types, and usage patterns, for the purposes of platform security, fraud prevention, and improving our services.

14. Refund Policy

Due to the irreversible nature of cryptocurrency transactions, Sundreas does not offer refunds for deposits, bets, or in-game losses. All cryptocurrency transactions are final once confirmed by the blockchain network.

Sundreas may temporarily suspend access to the platform for routine maintenance or system upgrades. We will make reasonable efforts to notify users in advance, but we are not liable for any losses incurred during such maintenance periods.
